Terms and Conditions of Transport of- Mas Volcán

Welcome to Mas Volcán, your trusted transportation provider for tourism in Guatemala. Before using our services, we ask that you carefully read the following Terms and Conditions that govern the provision of our transportation services. By making a reservation or using any of our services, you agree to these terms.
1. Services Offered
Mas Volcán offers private and group transportation to various parts of Guatemala, including but not limited to: cities, national parks, archaeological sites, volcanoes, and beaches. Our services include vehicles with trained drivers, with the option to add additional services such as car seat rentals, tour guides, and other requested services.
2. Reservations and Payments
Reservations must be made at least 48 hours in advance to ensure availability.
Reservations can be made through our website, by phone, or via email.
Payment can be made in cash, credit/debit card, or bank transfer, and must be completed before or during the service, as agreed upon with the client.
Prices are in USD and are subject to change without prior notice, but will remain fixed once the reservation is confirmed.
3. Cancellation Policy
Cancellation without charge: If you cancel the reservation at least 48 hours in advance, no cancellation fee will be charged.
Cancellation with charge: If the cancellation is made less than 48 hours in advance, a charge of 50% of the total service cost will be applied.
No Show: If the client does not show up at the agreed location without prior notice, no refund will be provided.
4. Client's Responsibilities
The client agrees to:
Arrive at the pickup location at the agreed time.
Comply with all local traffic and safety laws.
Maintain respectful behavior toward the driver and other passengers.
Ensure that all personal belongings, luggage, and valuables are properly stored and watched during the transportation.
5. Mas Volcán’s Responsibilities
Mas Volcán commits to providing a safe and efficient transportation service. However, we are not responsible for:
Delays or cancellations due to factors beyond our control, such as adverse weather conditions, traffic accidents, strikes, or natural disasters.
Losses or damages to personal belongings during transportation, unless such damages are caused by the direct negligence of our drivers or employees.
Accidents or injuries occurring during the transportation that are caused by the client, their reckless behavior, or non-compliance with safety rules.
6. Liability in Case of Accidents
In the event of an accident during transportation provided by Mas Volcán, the following applies:
Mas Volcán's Liability: If the accident is caused by the direct negligence of our drivers, Mas Volcán will assume responsibility for the material damages and physical injuries suffered by passengers, in accordance with local civil liability laws. This includes vehicle damage and injuries resulting from the driver’s conduct or mechanical failures of the vehicles under normal usage conditions.
Exemption of Liability in Case of Accident: Mas Volcán will not be responsible for accidents that occur due to:
Reckless or negligent behavior by the client (e.g., not wearing a seatbelt, attempting to open doors or windows during the trip, or engaging in other dangerous behaviors).
External factors beyond our control, such as collisions with other vehicles, unforeseen events on the road (accidents with other vehicles, poor road conditions, adverse weather conditions, etc.), or interference caused by third parties.
Travel Insurance: Mas Volcán recommends that clients have travel insurance that covers personal accidents, property damage, and other unforeseen incidents. In case of an accident, Mas Volcán will provide the necessary documentation for passengers to file claims with their insurance providers.
Actions in Case of an Accident: If an accident occurs during the trip, Mas Volcán commits to taking all necessary safety measures and cooperating with the relevant authorities. However, it is the client's responsibility to follow safety instructions and assist the driver or authorities as needed.
7. Safety
All passengers are required to wear their seatbelts at all times during the trip.
The use of car seats is mandatory for children under 12 years old. Car seats for children can be rented from partner providers we recommend who provide these devices in optimal safety conditions.
It is the client's responsibility to ensure that a car seat reservation is requested in advance when booking the service. Mas Volcán will not be responsible if the client has not requested the necessary equipment for the safety of minors.
The drivers of Mas Volcán are trained in safe driving techniques and first aid, but it is the client's responsibility to follow all established safety rules.
8. Modifications and Changes to the Service
Mas Volcán reserves the right to modify, suspend, or cancel any service in exceptional circumstances, such as bad weather or unforeseen situations. If the service cannot be provided as agreed, alternative options will be offered, or the full amount paid by the client will be refunded.
9. Limitation of Liability
To the extent permitted by law, Mas Volcán will not be liable for indirect, incidental, special, punitive, or consequential losses that may arise due to delays, damage to personal belongings, injuries, or losses related to the transportation service.
10. Personal Data Protection
Mas Volcán is committed to protecting the privacy and security of our clients' personal data. The information collected will be used exclusively to manage your reservation and provide you with the appropriate service. We do not share your information with third parties without your consent, unless necessary to fulfill the contracted service.
11. Force Majeure
We will not be responsible for any failure or delays in service due to events beyond our control, such as natural disasters, accidents, social unrest, government restrictions, or any other situation of force majeure.
12. Jurisdiction and Applicable Law
These Terms and Conditions are governed by the laws of the Republic of Guatemala. Any dispute or conflict related to Mas Volcán’s services will be resolved in the courts of Guatemala.
13. Acceptance of Terms
By making a reservation or using our services, you agree to comply with these Terms and Conditions. If you do not agree with any of the provisions in this document, please contact us before making your reservation.
